Terms of Service

Effective Date: January 29, 2026

1. Acceptance of Terms

By scheduling an appointment, receiving services, or accessing our website, you ("Client" or "Patient") agree to be legally bound by these Terms of Service, our Privacy Policy, HIPAA Notice, Refund & Cancellation Policy, Medical Disclaimer, Informed Consent Policy, Photo Release Policy, Minor Treatment Policy, Accessibility Policy, and all other policies and written consent forms referenced herein or signed in our office. These terms, together with all such policies and treatment-specific consent forms signed at the time of service, constitute the complete and binding agreement between you and Honey Rae Aesthetics ("Practice," "we," "us," or "our"). If you do not agree with any portion of these terms, you must discontinue use of our services immediately.

No Doctor-Patient Relationship via Website or Social Media. Access to this website, reading blog or educational content, following our social media accounts, sending messages through web forms, or any interaction with our digital presence does not create a doctor-patient, nurse-patient, or provider-patient relationship. A treating relationship is formed only after (a) an in-person consultation, (b) review and signing of treatment-specific consent forms at our office, and (c) the provider's acceptance of you as a patient for that specific treatment. Nothing on this website constitutes medical advice, diagnosis, or a recommendation for your individual case.

2. Medical Services and Scope of Practice

Honey Rae Aesthetics is a licensed medical aesthetic practice providing cosmetic and aesthetic medical treatments including, but not limited to:

  • Botulinum toxin injections (Jeuveau®, Dysport®, Xeomin®)
  • Dermal filler treatments (hyaluronic acid and other FDA-approved fillers)
  • Professional skincare treatments and chemical peels
  • Microneedling and radiofrequency treatments
  • Laser treatments and IPL therapy
  • Medical-grade skincare product sales
  • Aesthetic consultations and treatment planning

All treatments are performed by licensed healthcare professionals within their scope of practice. Services are for cosmetic enhancement purposes and are not intended to treat, cure, or prevent any disease or medical condition.

3. Client Eligibility and Requirements

Age Requirements:

  • Clients must be 18 years or older for most treatments
  • Clients aged 16-17 require parental consent and guardian presence
  • Certain treatments may have higher age requirements

Health Requirements:

  • Must provide complete and accurate medical history
  • Must disclose all medications, supplements, and allergies
  • Must not be pregnant or nursing (for applicable treatments)
  • Must be in general good health and suitable for treatment

4. Client Responsibilities and Obligations

Your active participation and honesty are essential for safe, effective treatment.

  • Medical Disclosure: Provide complete, accurate medical history including all prescription medications, over-the-counter supplements, medical conditions, previous aesthetic treatments, and allergies
  • Pre-Treatment Compliance: Follow all pre-treatment instructions including avoiding blood thinners, alcohol, and other specified substances when advised
  • Post-Treatment Care: Adhere strictly to all aftercare instructions to ensure optimal results and minimize complications
  • Appointment Punctuality: Arrive on time for scheduled appointments with completed intake forms
  • Communication: Immediately report any concerns, adverse reactions, or complications
  • Payment Compliance: Pay for services according to agreed payment terms and policies
  • Realistic Expectations: Understand that results vary and may require multiple treatments

Assumption of Risk. You acknowledge that all aesthetic and medical treatments — including but not limited to injectables, lasers, energy-based devices, chemical peels, and skincare treatments — carry inherent risks, including the rare but serious risks described in our Medical Disclaimer and in treatment-specific consent forms. By voluntarily choosing to receive treatment, you knowingly and voluntarily assume all such risks, including risks of bruising, swelling, infection, asymmetry, pigmentary changes, scarring, allergic reaction, vascular complications, and other known or unknown adverse outcomes. You further agree that Honey Rae Aesthetics is not responsible for outcomes arising from risks inherent to the procedure itself when treatment has been performed within the applicable standard of care.

Misrepresentation of Health Information. If you knowingly or negligently provide false, incomplete, or misleading information about your medical history, medications, pregnancy status, allergies, prior treatments, or any other health-related matter, we reserve the right to immediately terminate the appointment without refund, retain all payments as liquidated damages for the opened product and scheduled chair time, refuse future services, and pursue recovery for any costs or damages we incur as a result of such misrepresentation. You further agree to fully indemnify the Practice for any claim, injury, or complication arising from undisclosed or misrepresented health information.

5. Client Conduct & Safety

The safety and wellbeing of our staff and clients is non-negotiable.

Honey Rae Aesthetics maintains a zero-tolerance policy for harassment, discrimination, or abusive behavior directed at our staff, providers, or other clients. This includes but is not limited to:

  • Verbal abuse: Yelling, threatening language, demeaning or derogatory comments, or discriminatory remarks
  • Physical conduct: Any unwanted physical contact, intimidating gestures, or threatening behavior
  • Sexual harassment: Unwelcome sexual advances, inappropriate comments, or suggestive behavior toward any staff member
  • Digital harassment: Abusive or threatening messages via text, email, social media, or online reviews used as leverage

We reserve the right to immediately terminate any appointment, refuse future services, and permanently ban any individual who engages in such conduct. No refund will be issued for appointments terminated due to client misconduct. Incidents may be reported to law enforcement when appropriate.

General Right to Refuse Service. Honey Rae Aesthetics reserves the absolute right, at its sole discretion and for any lawful reason or no reason at all, to refuse service, decline to schedule an appointment, terminate an appointment in progress, or permanently refuse future services to any person. This includes, without limitation, refusal based on: our clinical judgment that a treatment is not medically appropriate or safe; unrealistic expectations; concerns about body dysmorphic disorder or capacity to consent; prior conduct; non-disclosure of medical information; non-payment history; abuse of our policies; or any other reason permitted by law. Refusal of service does not entitle the person refused to a refund beyond monies paid for services not yet rendered, and does not constitute discrimination or breach of contract.

Reviews, Publicity, and Defamation. We respect your right to leave honest reviews about your experience, and nothing in these Terms restricts truthful opinions, consistent with the federal Consumer Review Fairness Act. However, the Practice expressly reserves all rights and remedies available under law — including but not limited to defamation, libel, tortious interference, and trade-libel claims — against any person who publishes knowingly false, fabricated, or materially misleading statements about the Practice, its staff, or its services, whether on review platforms, social media, or elsewhere. Using false statements, threats of reviews, or public harassment as leverage to extract refunds, free services, or other concessions constitutes extortion and will be pursued accordingly.

6. Appointment Scheduling and Modifications

Scheduling: Appointments can be scheduled online, by phone, or in person. Confirmation is required within 24 hours of booking.

Changes and Cancellations: Must provide at least 24 hours advance notice. Late cancellations and no-shows are subject to fees as outlined in our Cancellation Policy.

Emergency Situations: Cancellation and no-show fees still apply. Honey Rae Aesthetics is not liable for any costs, expenses, or damages related to medical emergencies or any other circumstance.

7. Payment Terms and Financial Obligations

  • Payment Due: Payment is due in full at the time of service unless pre-arranged payment plans are established
  • Accepted Forms: Cash, credit cards, debit cards, and approved financing options
  • Package Purchases: Treatment packages must be used within specified timeframes and are non-transferable and non-refundable
  • Price Changes: Service and product prices may change at any moment without notice as supply, product, and service costs increase
  • Gift Cards & Pre-Paid Credits: Gift cards and pre-paid credits apply toward current pricing in effect at the time of redemption, not at the time of purchase. Price increases between purchase and redemption are the responsibility of the redeeming party, and may result in an out-of-pocket balance due at the time of service. Gift cards do not expire, in compliance with Utah consumer protection law.
  • HSA / FSA Payments: We accept HSA and FSA cards where the client's plan allows. Eligibility of cosmetic aesthetic services and retail skincare for HSA/FSA reimbursement is determined solely by your plan administrator and the IRS, not by Honey Rae Aesthetics. It is your responsibility to verify eligibility with your plan before use. In the event of a plan denial, audit, disallowance, recharacterization, or tax consequence relating to your use of HSA/FSA funds at our Practice, you agree that the charge remains valid and payable by you, and that the Practice is not liable for any resulting tax, penalty, or repayment obligation.
  • Outstanding Balances: Unpaid balances may be subject to additional collection efforts, including assignment to a collection agency and reasonable attorney fees and costs.

No Chargebacks. Pre-Dispute Notice Required. Because all services and purchases are final sales, and because treatment-specific consent is obtained before any service is rendered, you expressly agree not to initiate a credit card, debit card, or bank chargeback for any charge incurred at Honey Rae Aesthetics. If you believe a charge is in error or you are dissatisfied, you agree to first notify the Practice in writing at kendra@honeyraeaesthetics.com and allow the Practice thirty (30) days to investigate and respond before pursuing any payment-network dispute. Any chargeback initiated in violation of this clause constitutes a breach of these Terms, and you agree to reimburse the Practice for the full disputed amount plus any chargeback fees, bank fees, collection costs, and reasonable attorney fees incurred in recovering the charge, regardless of the chargeback outcome.

8. Treatment Outcomes and Expectations

No treatment outcome can be guaranteed, and individual results may vary significantly.

Treatment outcomes depend on numerous factors including individual anatomy, skin condition, age, lifestyle, adherence to aftercare, and biological response to treatment. We make no guarantees regarding:

  • Specific aesthetic results or degree of improvement
  • Duration of treatment effects
  • Need for additional treatments or touch-ups
  • Complete elimination of targeted concerns
  • Prevention of future aging or skin changes

9. Risks, Complications, and Informed Consent

All medical aesthetic treatments carry inherent risks and potential complications. While serious complications are rare when treatments are performed by qualified professionals, they can occur. Common risks include but are not limited to:

  • Temporary swelling, bruising, redness, or tenderness
  • Infection at injection or treatment sites
  • Allergic reactions to products used
  • Asymmetry or uneven results
  • Need for corrective treatments
  • Rare but serious complications specific to each treatment type

Detailed treatment-specific risks will be discussed during consultation and documented in treatment-specific consent forms.

10. Limitation of Liability and Indemnification

Limitation of Liability: To the maximum extent permitted by applicable law, Honey Rae Aesthetics' total aggregate liability for any and all claims arising from or related to services provided, retail products sold, or interactions with this website shall not exceed the total amount paid by the client for the specific treatment(s) or product(s) giving rise to the claim.

Excluded Damages: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost wages, lost opportunity, emotional distress, loss of enjoyment of life, reputational harm, or loss of business, even if we have been advised of the possibility of such damages.

Assumption of Inherent Risks. Client acknowledges and agrees that the inherent risks of aesthetic and medical treatments — as disclosed in the Medical Disclaimer, Informed Consent Policy, and treatment-specific consent forms — are not the responsibility of the Practice when treatment has been performed within the applicable standard of care. Dissatisfaction with aesthetic results, absent negligence, is not a basis for liability.

Warranty Disclaimer. Except as expressly set forth in these Terms or in a written consent form, all services and products are provided "as-is" and without any express or implied warranties of any kind, including without limitation warranties of merchantability, fitness for a particular purpose, satisfactory quality, or non-infringement. No guarantee is made as to specific aesthetic outcomes, duration of results, longevity of product effects, or suitability for any individual.

Client Indemnification: Client agrees to indemnify, defend, and hold harmless the Practice, its owners, providers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to: (a) client's failure to disclose medical information; (b) client's failure to follow pre- or post-treatment instructions; (c) client's misrepresentation of health status, age, identity, or consent capacity; (d) client's breach of these Terms; or (e) client's conduct on the Practice's premises.

Non-Enforceability Carve-Out. To the extent Utah or federal law prohibits the limitation of liability, exclusion of damages, or warranty disclaimer set forth in this Section as applied to a particular claim (for example, certain personal-injury claims where such limitations are void as a matter of public policy), those provisions shall apply only to the maximum extent permitted by law, and the remaining provisions of this Section and these Terms shall remain in full force and effect.

11. Intellectual Property and Confidentiality

Our website content, photography, and marketing materials are protected by copyright. "Honey Rae Aesthetics" and associated logos are trademarks of the practice. Client treatment records and personal information are kept strictly confidential under applicable state and federal privacy laws, including HIPAA where applicable.

12. Dispute Resolution

Governing Law: These Terms of Service and any disputes arising from or related to our services shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles.

Informal Resolution: Before initiating any formal dispute resolution, you agree to contact us in writing at kendra@honeyraeaesthetics.com describing the dispute. Both parties will attempt to resolve the dispute informally within 30 days of written notice.

Binding Arbitration: If informal resolution fails, any remaining dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall be conducted in Utah County, Utah. Each party shall bear its own attorney fees and costs; arbitrator fees shall be split equally unless the arbitrator determines otherwise.

Small Claims Exception: Either party may bring an individual action in small claims court in Utah County, Utah, if the claim falls within the court's jurisdictional limits.

Class Action Waiver: All disputes must be brought in an individual capacity. You agree to waive any right to participate in a class action, collective action, or representative proceeding.

Professional Malpractice Exclusion: Claims involving professional malpractice or medical negligence are excluded from the arbitration requirement and may be pursued through appropriate legal channels in the State of Utah.

Time Limitation: Any claim or dispute must be filed within one (1) year after the cause of action arises, or it is permanently barred, except where a longer period is required by applicable law.

13. Recording, Photography & Premises Policy

No unauthorized recording. Audio recording, video recording, live-streaming, or photography of staff, providers, other clients, or any treatment at our Practice is strictly prohibited without prior written permission from the Practice. Utah is a one-party consent jurisdiction for audio, but this policy is contractual — violation is grounds for immediate termination of service, removal from the premises, and pursuit of any available civil or criminal remedy. Violation may also constitute a HIPAA breach if it captures another client or PHI.

You acknowledge that the Practice may operate security cameras in non-treatment areas (such as the reception area, hallways, and entrances) for the safety of clients, staff, and property. Recording of treatment rooms by the Practice is limited to clinical documentation with separate written consent. See our Privacy Policy for further detail.

14. Force Majeure

Honey Rae Aesthetics shall not be liable for any failure or delay in performance, or for any damages alleged to result from such failure or delay, caused in whole or in part by circumstances beyond our reasonable control, including but not limited to: acts of God; severe weather, natural disasters, or public health emergencies; pandemic or epidemic; fire, flood, or power failure; equipment malfunction or supply chain disruption (including manufacturer backorder of neurotoxins, fillers, or device components); provider illness, injury, or incapacity; labor disputes; acts of government or regulatory authority; cyberattack or telecommunications failure; or any other event of force majeure. In such circumstances, the Practice will make commercially reasonable efforts to reschedule affected appointments; however, rescheduling is not guaranteed, and the Practice shall have no liability for any cost, loss, expense, or damage resulting from such circumstances. Deposits and pre-paid treatments will be held as credit for future services or rescheduled, at the Practice's discretion.

15. Email & Electronic Communications

By providing your email address or phone number, you consent to receive transactional communications from the Practice, including appointment confirmations, reminders, pre- and post-treatment instructions, receipts, and policy updates. Marketing communications (newsletters, promotional offers, new-service announcements) are sent on an opt-in basis where required by law.

  • CAN-SPAM Compliance: All marketing email includes a clear unsubscribe mechanism and our physical address. Unsubscribe requests are honored within ten (10) business days as required by federal law.
  • Unsubscribing: You may unsubscribe from marketing email at any time by clicking the unsubscribe link in any marketing message, or by emailing kendra@honeyraeaesthetics.com. Unsubscribing from marketing does not stop transactional communications related to your appointments and treatments.
  • SMS: SMS communications are governed by the SMS Communications section of our Privacy Policy.
  • Email Delivery: The Practice is not responsible for communications lost due to spam filters, incorrect addresses you provide, or delivery failures outside our control. It is your responsibility to maintain a working contact address and to contact the Practice if you have not received expected communications.

16. AI-Generated Content; No Warranty; Notice and Takedown

Use of Artificial Intelligence. Portions of the educational, marketing, and informational content on our website, blog, social media, email, and other digital channels — including, in many cases, entire blog posts, articles, captions, summaries, FAQs, treatment descriptions, and metadata — are generated, drafted, written, edited, translated, summarized, or otherwise produced in whole or in part by artificial intelligence tools, including large language models, generative AI systems, automated content pipelines, and machine-learning models (collectively, “AI Tools”). Such content is referred to herein as “AI Content.”

Automated Publication Without Human Review. You expressly acknowledge and agree that AI Content may be automatically generated and published on our website, blog, or other digital properties without human review, fact-checking, medical-professional oversight, editorial review, legal review, accuracy verification, or any form of pre-publication approval by the Practice or any of its owners, employees, contractors, providers, or agents. The Practice has no obligation to review, monitor, verify, fact-check, update, correct, or remove any AI Content, and any review that does occur is at the Practice’s sole discretion and does not create any duty to review other content.

Known Limitations of AI. AI Tools are known to produce content that is inaccurate, incomplete, outdated, misleading, biased, internally inconsistent, contextually inappropriate, or entirely fabricated (commonly referred to as “hallucinations”). AI Content may misstate facts, cite nonexistent sources, misrepresent medical, scientific, regulatory, or product information, contain typographical or translation errors, omit material information, or reflect outputs that the Practice has not endorsed and does not endorse. You should not rely on AI Content for any purpose and should independently verify any information before acting on it.

Not Medical Advice; No Provider Relationship. AI Content is provided strictly for general educational and informational purposes. AI Content does not constitute medical, nursing, pharmaceutical, diagnostic, therapeutic, or treatment advice; is not a recommendation, prescription, or solicitation to undergo any procedure or use any product; and does not establish a doctor-patient, nurse-patient, or provider-patient relationship of any kind. See Sections 1 and 4 above and our Medical Disclaimer. Reliance on AI Content is solely at your own risk.

“AS IS” / “AS AVAILABLE”; Disclaimer of All Warranties. All AI Content is provided “AS IS” and “AS AVAILABLE,” with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, the Practice and its owners, employees, contractors, providers, agents, affiliates, licensors, and AI vendors expressly disclaim any and all representations, warranties, conditions, and guarantees of any kind, whether express, implied, statutory, or otherwise, including without limitation any warranty of accuracy, completeness, currentness, reliability, quality, originality, non-infringement, title, merchantability, fitness for a particular purpose, or that AI Content is free of errors, hallucinations, defamatory statements, infringing material, or harmful, offensive, or unlawful content.

Limitation of Liability for AI Content. To the maximum extent permitted by applicable law, the Practice and its owners, employees, contractors, providers, agents, affiliates, licensors, and AI vendors shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or any other damages whatsoever — including without limitation personal injury, bodily harm, medical complications, adverse outcomes, emotional distress, loss of profits, loss of data, loss of business, reputational harm, defamation, infringement, or any other loss — arising out of, related to, or in connection with any AI Content, your access to or reliance on any AI Content, any errors, inaccuracies, omissions, or hallucinations in AI Content, or the publication of AI Content without human review. This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, statute, or otherwise) and even if the Practice has been advised of the possibility of such damages. Your sole and exclusive remedy for dissatisfaction with any AI Content is to stop accessing the content and notify the Practice via the takedown procedure below.

Indemnification. To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the Practice and its owners, employees, contractors, providers, agents, and affiliates from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising from your reliance on, redistribution of, or use of any AI Content in violation of these Terms.

Notice and Takedown. If you believe any AI Content is inaccurate, misleading, defamatory, infringing, harmful, or otherwise objectionable, please notify us at kendra@honeyraeaesthetics.com with a description of the content and the URL. The Practice will review the report in its sole discretion and may, but is not obligated to, correct, edit, take down, or otherwise modify the content. Removal or correction of any AI Content shall not be deemed an admission of liability, fault, or wrongdoing.

Acknowledgment. By accessing this website, blog, or any of our digital properties, you acknowledge that you have read, understood, and agreed to the terms of this Section 16 and that you knowingly and voluntarily assume all risk associated with AI Content.

17. Modifications and Updates

We reserve the right to modify these Terms of Service at any time. Significant changes will be communicated via email or posted notice. Continued use of our services after changes constitutes acceptance of the modified terms. Current terms are always available on our website.

18. General Provisions

Governing Language. The English-language version of these Terms and all associated policies is the official, authoritative, and legally binding version. Any translation (including Spanish) is provided solely as a courtesy to assist with comprehension. In the event of any discrepancy, ambiguity, or conflict between the English version and any translation, the English version shall control and govern in all respects.

Severability. If any provision of these Terms is held to be invalid, illegal, unenforceable, or void by a court of competent jurisdiction or an arbitrator, such holding shall not affect the validity, legality, or enforceability of any other provision, and the remainder of these Terms shall continue in full force and effect. The invalid provision shall be deemed modified to the minimum extent necessary to make it enforceable while preserving the parties' original intent, and if no such modification is possible, the provision shall be severed.

Entire Agreement. These Terms of Service, together with our Privacy Policy, HIPAA Notice, Refund & Cancellation Policy, Medical Disclaimer, Informed Consent Policy, Photo Release Policy, Minor Treatment Policy, Accessibility Policy, and all written consent forms signed at our office, constitute the entire agreement between you and Honey Rae Aesthetics with respect to the subject matter hereof and supersede all prior or contemporaneous oral or written communications, proposals, representations, or understandings.

No Waiver. The failure of the Practice to enforce any provision of these Terms on any occasion shall not constitute a waiver of the Practice's right to enforce the same or any other provision on any other occasion.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. The Practice may assign its rights and obligations under these Terms to any successor or affiliate.

Headings. Section headings in these Terms are for convenience of reference only and shall not affect the interpretation or construction of any provision.

Survival. The provisions of Sections 5 (Conduct), 9 (Risks), 10 (Limitation of Liability and Indemnification), 12 (Dispute Resolution), 13 (Recording), and this Section 18 (General Provisions), together with any other provision that by its nature should survive, shall survive the termination of these Terms or your relationship with the Practice.

Premises Security & On-Site Recording

For the safety of our clients, staff, and property, Honey Rae Aesthetics may operate video surveillance cameras in non-treatment areas of our facility, including the reception area, hallways, entrances, and exterior of the building. These cameras do not record audio and are never placed in treatment rooms, restrooms, or changing areas.

  • Purpose: Security, incident documentation, dispute resolution, and verification in the event of theft, injury, or misconduct.
  • Retention: Security footage is typically retained for 30-60 days and automatically overwritten unless preserved for an active investigation or legal matter.
  • Access: Security footage is accessed only by the owner and designated management staff, or pursuant to lawful request by law enforcement or legal process.
  • No Streaming or Public Display: Security footage is never streamed publicly, posted online, or shared with third parties except as required by law.
  • Client Photography / Recording: As set forth in our Terms of Service, clients may not record or photograph staff, other clients, or treatments on our premises without prior written permission.

6. Uses and Disclosures Requiring Authorization

Refund & Cancellation Policy

All procedures and purchases are final sales. No procedure, skincare product, gift card, or other purchase is refundable under any circumstances. Please review our refund and cancellation terms carefully before booking.

Refund Policy

NO REFUNDS after the service is provided. Absolutely no refunds. Under no circumstance do we offer a partial refund or additional complimentary care.

All aesthetic procedures are considered final sales and are non-refundable. Results may vary based on individual factors, and questions can be addressed by our experienced team. A follow-up appointment is always recommended.

Touch-Up Policy

We want you to love your results. For injectable treatments (neurotoxins and dermal fillers), we may offer a touch-up appointment within 14 days of your original treatment if results are not as expected. Touch-ups are intended to refine results, not provide additional full treatments.

Honey Rae Aesthetics reserves the absolute right, at its sole discretion, to refuse, deny, or limit any touch-up request for any reason or no reason at all. Touch-ups are a courtesy, not a guarantee, entitlement, or part of the original purchase. A request for a touch-up is not a right, and refusal of a touch-up does not entitle the client to a refund, credit, or any other compensation.

This refusal-of-service policy applies to elective touch-up requests only. It does not apply to genuine medical emergencies, adverse reactions, or clinical complications resulting directly from treatment performed at our practice — those are addressed separately under Adverse Events & Complications below.

Adverse Events & Complications

In the rare event of an adverse reaction or complication directly resulting from treatment provided at our practice, we will:

  • Provide a follow-up appointment
  • Administer corrective treatment when clinically appropriate (e.g., hyaluronidase for filler dissolution)
  • Refer to appropriate medical care if the complication is beyond our scope of practice

72-Hour Reporting Requirement. Any suspected adverse reaction, complication, or unexpected symptom must be reported to the Practice within seventy-two (72) hours of onset by calling (801) 210-9268 or emailing the Practice. Failure to report within this window — except in cases of life-threatening emergency, in which case 911 should be called first — forfeits your eligibility for corrective treatment at no charge and may affect the Practice's ability to evaluate causation. This reporting window exists because aesthetic complications are time-sensitive: the earlier we see you, the more effectively we can help.

Complications arising from a client's failure to follow pre- or post-treatment instructions, failure to disclose medical history, or normal expected side effects (temporary swelling, bruising, redness) are not eligible for corrective treatment at no charge. Absolutely no refunds after the service is provided. Under no circumstance do we offer a partial refund or additional complimentary care.

Withdrawal of Consent During Treatment

Once a treatment has begun, the full price remains owed. A treatment is considered to have begun when any of the following occurs: a vial, syringe, or product package has been opened or drawn up for you; a laser, device, or energy source has been activated on your skin; a peel or topical has been applied; or any injection has been initiated. You retain the right to withdraw consent and stop the treatment at any time, but opened product cannot be resterilized, reused, or returned, and provider and chair time cannot be recovered. Partial treatments, interrupted treatments, and treatments stopped at the client's request are billed at the full original price and are non-refundable.

Retail Products

All skincare product sales are final. Not refundable. Opened products cannot be returned due to hygiene and safety regulations. Gift cards are non-refundable — all sales final.

Warranty Disclaimer — Products Sold "As-Is." Except for the manufacturer's warranty (if any) that passes through directly to you, all retail skincare products are sold "AS-IS" and "WITH ALL FAULTS." To the maximum extent permitted by law, Honey Rae Aesthetics expressly disclaims all warranties, whether express or implied, including without limitation any implied warranty of merchantability, fitness for a particular purpose, non-infringement, or satisfactory quality. The Practice makes no representation that any product is suitable for your individual skin type, condition, sensitivity, or goals. Skin reactions, breakouts, irritation, or allergic response to a product are known possibilities and do not entitle you to a refund or exchange. Not a Substitute for Medical Care: Our treatments are cosmetic enhancements and do not replace regular medical care or treatment of medical conditions by your physician.

Not a Hospital — No Emergency or Inpatient Capabilities. Honey Rae Aesthetics is an outpatient aesthetic clinic. We are not a hospital, urgent care facility, or emergency department. We do not have the staffing, equipment, medications, or infrastructure to stabilize life-threatening emergencies, perform resuscitation beyond basic first aid, administer general anesthesia, perform surgery, or provide overnight or inpatient care. In the event of any medical emergency on our premises, our role is limited to calling 911 and providing basic support within the scope of our staff's training while emergency medical services respond. If you have a pre-existing condition that may require emergency medical intervention during treatment, you must disclose this before any service is provided, and we may decline to treat you in the interest of your safety.

Photo Release Policy

Effective Date: January 29, 2026

Photography consent is separate from treatment consent and is always optional.

Marketing & Publication Photos Require a Separate, Signed Photo Release. We only use a client's photograph for marketing, social media, educational, or publication purposes when that client has signed a separate, written Photo Release Form specifically authorizing each category of use. Verbal consent, a social-media tag, a text message, a comment, or silent acquiescence is not sufficient. If you have not signed a written release, your photograph will not appear in our marketing.

1. Types of Photography

Clinical Documentation Photography:

  • Purpose: Medical record keeping, treatment planning, and progress documentation
  • Scope: Before/after photos, treatment area documentation, progress tracking
  • Storage: Secure medical records system, HIPAA-compliant
  • Access: Limited to treatment team and you
  • Consent Required: Yes, as part of treatment consent

Marketing and Educational Photography:

  • Purpose: Website, social media, educational materials, advertising
  • Scope: Before/after galleries, testimonial photos, promotional materials
  • Storage: Marketing databases and public platforms
  • Access: Public viewing on websites, social media, and marketing materials
  • Consent Required: Yes, separate written consent required

Professional/Publication Photography:

  • Purpose: Medical journals, conference presentations, training materials
  • Scope: Case studies, research publications, educational presentations
  • Storage: Professional archives and publication databases
  • Access: Medical professionals, researchers, students
  • Consent Required: Yes, specific consent with detailed usage rights

2. Consent Requirements

Separate Consent Forms:

Photography consent is always separate from treatment consent. You may:

  • Consent to treatment but decline all photography
  • Consent to clinical photos only
  • Consent to some but not all uses of your photos
  • Consent to specific platforms or publications
  • Limit the time period for photo usage

Specific Usage Rights:

Your consent will specify exactly how your photos may be used, including specific websites, social media platforms, publications, or presentations. Usage outside of your consent is strictly prohibited.

Identity Protection Options:

  • Full Face Visible: Complete photos with face and treatment area visible
  • Partial Coverage: Eyes blurred or covered for partial anonymity
  • Treatment Area Only: Close-up shots of treatment area without face
  • Complete Anonymity: All identifying features obscured or removed

3. Your Rights Regarding Photography

Right to Decline:

You have the absolute right to decline photography for any or all purposes. Declining photography will not affect the quality of your care or your relationship with our practice.

Right to Withdraw Consent:

  • You may withdraw photo consent at any time by written notice to kendra@honeyraeaesthetics.com
  • We will use commercially reasonable efforts to remove your photos from our owned websites and our primary social media accounts within a reasonable period after receiving your written withdrawal (typically thirty to sixty days, subject to platform constraints and cache propagation)
  • We cannot recall materials already published, printed, distributed, reposted by third parties, or cached or indexed by search engines or archives outside our control, and we make no guarantee as to the removal of such materials
  • Clinical documentation photos remain in medical records as required by Utah medical record retention law (minimum 10 years)
  • Withdrawal of photo consent does not entitle you to compensation or refund for any previous authorized use

Right to Review:

You have the right to review photos before they are used for marketing or publication purposes. You may request specific photos be excluded from use.

Compensation — At the Practice's Sole Discretion:

Photography consent is voluntary and is not exchanged for compensation unless compensation is expressly stated in a written Photo Release Form signed by both parties. The Practice may, in its sole discretion, offer specific promotional items (such as a complimentary service or retail product) in a written release in exchange for broader usage rights for a particular campaign. No right to compensation, royalty, residual, or profit-sharing exists absent express written terms, and signing our standard Photo Release does not entitle you to payment of any kind.

4. Photo Security and Storage

Clinical Photos: Stored in HIPAA-compliant medical records system with encryption and access controls. Retained according to medical record retention requirements.

Marketing Photos: Stored in secure marketing databases with backup systems. Access limited to authorized marketing and clinical staff.

Third-Party Use: Photos shared with authorized third parties (publications, educational institutions) include usage agreements protecting your rights.

5. Photo Usage Guidelines

Professional Standards: All photos are taken and used in accordance with professional medical photography standards and ethical guidelines.

No Alteration: Clinical documentation photos are never altered. Marketing photos may be enhanced for lighting and clarity but not to misrepresent results.

Respectful Use: All photo use maintains dignity and professionalism. Photos are never used in a manner that could be considered exploitative or inappropriate.

6. Social Media and Digital Sharing

Platform-Specific Consent: Separate consent required for each social media platform (Instagram, Facebook, TikTok, etc.) due to different terms of service and sharing policies.

Tagging Policy: We will not tag you in posts without explicit permission. You may choose to share or comment on posts featuring your results.

User-Generated Content — Tagging Is Not Consent. If you post your own before/after photos to social media and tag our practice, we are grateful — but a tag, mention, DM, or social-media comment does not grant us the right to repost or republish your content on our channels. We will not repost, share, or use your content in our marketing unless you have provided separate written permission. Conversely, you retain all rights to your own posts and are responsible for any content you publish.

Minor Treatment Policy

Effective Date: January 29, 2026

Special requirements apply to aesthetic treatments for patients under 18 years of age.

1. Age Requirements and Restrictions

Under 16 Years Old:

  • General Policy: No elective aesthetic treatments
  • No Injectables: We do not administer neurotoxins, fillers, or any injectable treatments to minors, regardless of medical indication
  • Required Documentation: Medical referral, specialist recommendation, insurance pre-authorization
  • Parental Involvement: Both parents must consent and attend all appointments

Ages 16-17 Years:

  • Limited Treatments: Conservative skincare treatments and specific injectables only
  • Approved Treatments: Professional facials, chemical peels (light), acne treatments
  • Prohibited Treatments: No neurotoxins, no lip filler, no dermal fillers of any kind for any minor under 18 — no exceptions
  • Consultation Period: Minimum 2-week waiting period between consultation and treatment

Age 18 and Above:

Full access to all aesthetic treatments with standard consent procedures. Adult children may still benefit from parental support during decision-making.

2. Parental Consent Requirements

Legal Guardian Documentation:

  • Valid government-issued ID for parent/guardian
  • Birth certificate or legal guardianship papers
  • Custody documentation if applicable
  • Both parents must consent unless single-parent custody is documented

Informed Consent Process:

  • Parent/guardian must receive the same informed consent as adult patients
  • Minor must provide "assent" (agreement to treatment)
  • Additional time provided for family discussion and decision-making
  • Right to change mind up until treatment begins

Minor's Right to Dissent at Any Time. A minor's assent can be withdrawn at any moment. If a minor expresses discomfort, hesitation, distress, or refusal — by word, gesture, tears, or behavior — before or during any procedure, we will stop treatment immediately, regardless of parental or guardian direction to continue. Parental consent authorizes treatment; it does not override a minor's present refusal. Financial obligations for opened product, drawn doses, device consumables, and chair time already incurred remain the responsibility of the parent or guardian as described in the Refund & Cancellation Policy. Our priority is the minor's emotional and physical safety over any scheduled procedure.

Appointment Attendance:

  • Parent/guardian must attend initial consultation
  • Parent/guardian must be present during all treatments
  • Follow-up appointments may be attended by minor alone (16-17) with prior written consent
  • Emergency contact must be immediately available during treatments

3. Psychological Maturity Assessment

Motivation Evaluation: We assess whether the minor's desire for treatment comes from personal motivation or external pressure (peers, parents, social media).

Realistic Expectations: Minor must demonstrate understanding of treatment outcomes, limitations, and potential need for future treatments.

Decision-Making Capacity: Assessment of the minor's ability to understand and weigh risks and benefits independently.

Mental Health Screening: Evaluation for body dysmorphic disorder, depression, or other conditions that might affect treatment decisions.

4. Treatment-Specific Guidelines for Minors

Skincare Treatments:

  • Ages 13-15: Basic facials, acne treatments, gentle chemical peels
  • Ages 16-17: Moderate chemical peels, microdermabrasion, LED therapy
  • Home Care: Education on appropriate skincare routines and products

Injectable Treatments:

We do not provide injectable treatments to any minor under 18 — no exceptions. This includes all neurotoxins (Jeuveau, Xeomin, Dysport), dermal fillers, and biostimulators, regardless of medical indication or parental consent.

Laser and Energy Treatments:

  • Hair Removal: Ages 16+ with demonstrated emotional maturity
  • Acne Treatment: Ages 14+ with dermatologist recommendation
  • Skin Rejuvenation: Generally deferred until 18+ unless medical necessity

5. Special Considerations

Payment and Financial Responsibility:

  • Parent/guardian is financially responsible for all treatments
  • Payment required before treatment begins
  • Cancellation policies apply with parent/guardian responsible for fees
  • Insurance coverage varies; verification required before treatment

Privacy and Confidentiality:

  • Medical records shared with consenting parent/guardian
  • Mature minors (16-17) may have limited privacy rights for certain treatments
  • Photography consent requires both minor and parental agreement
  • Social media and marketing use requires additional permissions

Emergency Protocols:

  • Parent/guardian emergency contact must be immediately reachable
  • Emergency treatment may be provided without parental consent if life-threatening
  • Alternative emergency contacts required in case primary guardian unavailable
  • Hospital transport arrangements pre-established with parental consent

6. Refusal of Treatment

Professional Discretion: We reserve the right to refuse treatment to any minor if we believe it is not in their best interest, regardless of parental consent.

Reasons for Refusal: Unrealistic expectations, psychological concerns, medical contraindications, insufficient maturity, or external pressure.

Alternative Recommendations: When treatment is declined, we provide alternative suggestions such as skincare education, counseling referrals, or deferral until appropriate age.
